Alimony

Hope A. Lang is experienced in handling high income and high asset divorces which often involve complex asset evaluation, the evaluation of businesses, and determining the true stream of income from a business, which may involve hidden assets and cash income.

Hope A. Lang will help you resolve the following, although not all inclusive, issues related to the distribution of marital property and marital debts and appropriate alimony:

  • The income and earning capacity of you and your spouse, including educational background, training, employment skills, work experience, length of absence from the job market, custodial responsibilities for children, and the time and expense necessary to acquire sufficient education or training to enable you to become self supporting at a standard of living reasonably comparable to that enjoyed during the marriage;
  • The contribution by you to the education, training or earning power of your spouse;
  • The contribution of you, the husband or wife, to the acquisition, dissipation, preservation, depreciation or appreciation in the amount or value of the marital property.
  • The contribution of you, the husband or wife as a homemaker or caregiver;
  • The present value of and distribution of the marital property including pensions, no  matter which party earned the pension or whose name is on the pension plan;
  • The distribution of family businesses and income from such businesses;
  • The distribution of investment portfolios;
  • The debts and liabilities of you and your spouse;
  • The standard of living established during the marriage;
  • The economic circumstances of each party at the time the division of property becomes  effective;
  • The extent to which you deferred achieving your career goals while you were married.

Hope A. Lang  can assist you, where appropriate, in obtaining pre divorce spousal support and post-divorce alimony.  As  your advocate,  Hope A. Lang can represent you in negotiating for alimony, whether it be permanent lifetime alimony; limited duration alimony for a defined number of years; rehabilitative alimony to assist you while you obtain an education or help you to increase your earning power post divorce; or reimbursement alimony which might be appropriate for a spouse who forgone obtaining his/her education and worked in order to enable the other spouse to obtain a higher education.
